These are the terms of service for the Edaiga website at www.edaiga.com.
By using the site, you agree to these terms. If you do not agree, please do not use the site.
These terms cover how you can use the website itself: what it is, what we and you can do with the content here, and where the limits are. They do not cover the terms of an actual consulting engagement with us. When we work together on a project, the terms of that engagement live in the proposal and contract you sign with us. Where the two ever conflict, the engagement contract takes precedence for that work.
Who we are
The website is operated by Kloppers Ventures LLP, a limited liability partnership registered in England and Wales (LLP number: [LLP number to be confirmed], registered office: High Chimneys, Hurst, RG10 0TH, United Kingdom), trading as Edaiga.
Where we say "we", "us", or "Edaiga" below, we mean Kloppers Ventures LLP. Where we say "you", we mean you.
Using the site
You can use the Edaiga website to read what's on it, contact us through the form or by email, subscribe to the newsletter, and share a link to a page on the site by any normal means (email, message, social post).
You may not:
- copy, republish, mirror, or substantially reproduce the site or its content without our written permission
- use the site or its content to train, fine-tune, or otherwise feed any machine learning model, dataset, or AI system without our written permission
- attempt to gain unauthorised access to any part of the site, its server, or the systems behind it
- introduce viruses, malware, or any other malicious code
- use any automated means (scrapers, bots, crawlers other than legitimate search-engine crawlers respecting our robots.txt) to harvest content
- use the site in any way that breaks any law, infringes anyone's rights, or causes us reputational harm
Intellectual property
All content on this website is the property of Kloppers Ventures LLP or its licensors. This includes the writing, the case studies, the frameworks, the imagery, the design, the source code, and the Edaiga name and logo. The book Start With AI: A Manifesto for the New Era of Leadership is the separate copyright of Jean Pierre Kloppers; references to it on this site are made with his permission.
All rights are reserved. You may not copy, distribute, republish, modify, sell, sublicense, create derivative works from, or otherwise exploit any part of the site or its content without our prior written consent.
The case studies on this site are anonymised at the relevant clients' request. The underlying details, including identifying information, are confidential. Anything visible on the site is what we have been authorised to share.
Submissions through the site
When you fill in the contact form or the newsletter form, your submission is handled in line with our Privacy Policy. We use what you send us to reply to you, to provide the service you have asked for, and for the purposes set out in the policy.
You confirm, by submitting, that anything you tell us is yours to share, accurate, and not confidential to anyone else.
Third-party links
The site links to third-party sites and services. The most prominent are Amazon UK (where the book is sold), the Information Commissioner's Office at ico.org.uk, and the European Data Protection Board at edpb.europa.eu. We are not responsible for the content of those sites or for any consequences of you using them. Their terms apply when you visit them.
Not professional advice
The articles, frameworks, case studies, and other content on this site are general information about how we think about AI in business. They are not bespoke advice for your situation. AI strategy, like any consequential business decision, depends on facts about your business that we cannot know from a website alone.
If you want advice that takes those facts into account, contact us and we will discuss whether an engagement makes sense. Until we have a signed contract, nothing here is advice you can act on.
Disclaimer of warranties
We try to keep the site accurate, up to date, and available. We cannot guarantee any of those things absolutely. The site is provided "as is", without warranties or conditions of any kind, express or implied, except those that cannot be excluded by law.
We are not liable for the unavailability of the site or any errors in its content, except where such liability cannot be excluded by law.
Limitation of liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by English law.
Subject to that, to the maximum extent permitted by law, our total liability to you arising out of your use of this website (whether in contract, tort, breach of statutory duty, or otherwise) is limited to one hundred pounds sterling.
We are not liable for any indirect or consequential loss, loss of profits, loss of business, loss of data, or loss of opportunity, even if we have been advised of the possibility of that loss.
The limits in this section apply to your use of the website as a public visitor. Any consulting engagement we agree to undertake will have its own liability provisions in the contract for that engagement, which will override these provisions for that work.
Privacy
How we handle personal information is set out in our Privacy Policy. By using the site, you accept that policy alongside these terms.
Changes to these terms
We may update these terms from time to time. When we do, the "Last updated" date at the top of this page will change. If a change is material, we will flag it on the homepage for a reasonable period.
Your continued use of the site after a change means you accept the updated terms. If you do not, please stop using the site.
Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any dispute arising from your use of the site will be subject to the exclusive jurisdiction of the courts of England and Wales, except that we may bring proceedings against you in a court in your country of residence if that becomes necessary.
